PERTH, Aug 30 AAP - The West Australian government is under pressure from business
and the opposition to reveal what changes it will make to the state's industrial relations
(IR) system.
After WA Premier Colin Barnett junked an $850,000 review of the IR system by lawyer
Steven Amendola earlier this year, the state is undertaking a second review.
Marcia Kuhne, from the Chamber of Commerce and Industry of WA (CCI), said the government
began work earlier this year to determine what changes it would make to IR.
"We were somewhat alarmed when we heard they were not going to do anything with (the
review by) Amendola, but the minister has assured us the government is committed to reform,"
Ms Kuhne told AAP.
Ms Kuhne said IR reform was long overdue, with many people unhappy about the government's
inaction.
WA is the only state that has not signed up to the national workplace relations system,
but Commerce Minister Simon O'Brien indicated last week it was seeking to harmonise its
laws with the federal system.
Under the national Fair Work Act, small businesses are exempt from unfair dismissal
claims by workers who have been employed for less than 12 months.
But in WA there are no exemptions, causing confusion among unincorporated small businesses
covered by WA's IR laws, Ms Kuhne said
People who should be directing claims to the federal system were taking them to the
state industrial relations commission, which did not have jurisdiction to hear them, she
said.
She also said the state's more than 200 awards were out of date and should be harmonised
with the federal system.
Under the state laws, unions can enter worksites alleging a safety breach without providing
any proof, Ms Kuhne said.
"It's very easy for a union to enter a construction site and work around the sites,
perhaps to sign members up, on the allegation of a safety breach," she said.
Opposition IR spokesman Fran Logan said after being "embarrassed by the farce surrounding
the rejection of the $850,000 Amendola review", the government must announce what changes
it will make.
"Almost three years into its term and we are still no closer to knowing what plans
the Barnett Government has for industrial relations in WA," he said.
Mr Barnett refused to answer questions about possible changes on Tuesday but said he
wanted to preserve "consistency".
"I don't think we need to confuse employers or employees," he said.

VIC:Vic Police to rescue injured hiker
MELBOURNE, Dec 4 AAP - A police search and rescue team will walk 9km into Victoria's
Alpine National Park to rescue a hiker who fell and injured himself the night before.
The two hikers went into the national park on Friday night when one of them, a 54-year-old
man, fell at Eagle Peaks, south of Mt Buller.
A helicopter was called in on Friday night but was unable to winch the injured hiker
out due to weather conditions, police said.
The search and rescue team will walk 9km from the walking track at Sheep Yard Flat
and is expected to reach the injured hiker later on Saturday morning.

The federal government's hinted its decision to delay its emissions trading scheme
could cost jobs.
Climate Change Minister PENNY WONG says Senate troubles and slower-than-expected international
progress on the issue have forced Labor to delay the scheme until at least 2013.
Senator WONG says she can't rule out job cuts within her department as a result of the decision.
She's defended the delay .. telling ABC Radio it will take time for greater climate
change clarity to come internationally.

MELBOURNE, Dec 14 AAP - A drunk, drugged and speeding motorist who killed a cyclist
last Christmas Eve while driving to buy more drugs has been jailed for 13 years.
Luke Adam Shields, 32, of Mentone, was at least four times over the blood-alcohol limit
when he crashed into brothers Sean and Alun (Alun) Brindle, who were cycling along Beach
Road in the Melbourne suburb of Mentone.
Trainee ambulance paramedic Sean Brindle, 35, who was visiting Melbourne from Perth
to spend Christmas with family, suffered severe brain injuries and died three days later
in hospital, the Victorian County Court heard on Monday.
His wife of seven months was nine weeks' pregnant at the time and has since given birth
to a daughter.
Alun Brindle, 33, suffered severe head and leg injuries and spent two weeks in a coma.
It is uncertain whether Alun Brindle, a highly regarded Royal Australian Navy lieutenant,
will ever be able to return to full duties, the court heard.
The brothers, both keen cyclists, were riding together for the first time in 12 months.
They were riding in single file along the road which is popular with cyclists.
Shields and his girlfriend had consumed four bottles of wine and he had taken LSD.
He had a blood alcohol concentration of .221 and was travelling at a minimum of 77km/h
in a 60km/h zone when he hit the pair.
Sean Brindle was thrown 51 metres and his brother 68 metres.
The court heard Shields had a history of drug abuse and prior convictions for drink driving.
He has also been convicted of driving over the speed limit on Beach Road.
Judge Tony Duckett described the offending as serious.
"Your offending in relation to the culpable driving count is high on the calendar of
criminality for such an offence," he said.
Shields, who pleaded guilty to culpable driving and negligently causing serious injury,
must serve a minimum of 10 years jail before being eligible for parole.
He is also disqualified from driving for two years after his release.

Qld: Greenpeace protesters scale another coal terminal
Greenpeace activists have disrupted a Queensland coal terminal by chaining themselves
to a 50m high loader .. their second protest against climate change inaction in as many
days.
Greenpeace has escalated its calls for real action on climate change by disrupting
coal loading at Hay Point Coal Terminal in Mackay.
Activists have scaled a 50-metre high coal loader and have used tightly bound chains
to lock themselves to the structure to stop its operation.
They conducted a similar protest at the Xstrata Coal operated Abbot Point terminal
.. 25km north of Bowen in north Queensland .. yesterday.
Police have arrested six people at Hay Point .. but four protesters are still chained
to the top of the coal loader and have disrupted the terminal since about 7.30 this morning.

SYDNEY, Feb 11 AAP - Angela Liati was happy to lie to police about driving Marcus Einfeld's
car the day it was caught speeding, but only became concerned when the press got a hold
of her statement, prosecutors say.
Liati, 56, told police she was behind the wheel of the former Federal Court judge's
silver Lexus when it was snapped travelling at 60km/h in a 50km/h zone in Sydney's north
on January 8, 2006.
Einfeld, who initially denied driving the car, later pleaded guilty to the speeding offence.
Liati has pleaded not guilty in the NSW District Court to making a false statement
to police with the intention of perverting the course of justice.
She has admitted to fabricating parts of her first statement to police, but says it
was only meant to be a "casual draft" version of events.
Liati, who is defending herself, has told the jury that while she was in Einfeld's
car, she may have confused the date.
While cross-examining Liati on Wednesday, crown prosecutor Lou Lungo said it was clear
she had only become concerned about the statement once the press got their hands on it.
"You never complained ... in your first on-air (radio) interview about your statement
being released to police, did you?" Mr Lungo asked Liati.
"I don't know if I did, but why would I?" she replied.
"You complained about it being released to the media though, didn't you?" he said.
"That's what I was upset about," she said.
Mr Lungo said it had been Liati's intention all along to give police the statement.
The crown is preparing to make its final address to the jury.

CANBERRA, Aug 24 AAP - Forking out close to $17 million in taxpayers money for every
gold medal won by an Australian at the Beijing Olympics is value for money, federal Opposition
Leader Brendan Nelson says.
Fairfax reports the cost of each gold medal won by an Australian in Beijing has cost
taxpayers $16.7 million.
This cost does not take into account state government funding and the cost of high-tech
sporting infrastructure, the report says.
Dr Nelson said the nation was very proud of the athletes' performances.
"It is value for money," Dr Nelson told Network Nine.
"Every single Australian is immensely proud of the achievements of our athletes...for
all of those who have competed it has just been inspiring."
Dr Nelson said the federal government should look at extending sports funding.
"There's a very strong argument for looking at how we can further invest, not only
in elite level sport but also sport generally in our country."
"I would very happy to have some discussions with Mr Rudd and key members of the sporting
community about what more we can do as a nation to support our athletes in an increasingly
competitive world."
This could include a lottery style funding system, Dr Nelson said.
Australia is in sixth place on the medal table with 14 gold, 15 silver and 17 bronze.

CANBERRA, Dec 14 AAP - East Timor says it is not concerned about a "left, centre or
right" Australian government - it just wants the country's troops to stay as long as needed.
Prime Minister Kevin Rudd is due to arrive in Dili today along with Foreign Minister
Stephen Smith on their way home from the climate change summit in Bali.
About 800 Australian troops have been in the troubled former Indonesian province since
early this year after violence erupted in the build-up to the April presidential elections.
The new East Timor government has been in power for about six months but tensions remain
and 30,000 people are still living in refugee camps.
Mr Rudd has indicated that during his visit he will reassure President Jose Ramos Horta
that Australian soldiers will remain for as long as they are needed.
Deputy Prime Minister Jose Luis Guterres said that move would be greatly appreciated.
"We do appreciate the commitment by the Australian government and we hope that the
current prime minister also will accept the continuation of troops in East Timor," Mr
Guterres told ABC radio today.
He said East Timor's relationship with Australia would not change under the new Labor government.
"I think that we are neighbours and whether we have left, centre or right government
it is our duty to maintain good relations of neighbours and friendship."

You cannot separate the man from the car. Carol learned this 34 years ago, before she exchanged rings and vows. She was driving to work in her father's '58 Oldsmobile, trying everything to turn a colleague's eyes her way.
Charlie didn't seem interested.
"When I got my '67 Camaro," Carol said, "then I got asked out."
They are standing on their driveway in Lincoln Park Charlie Ehm next to his '70 Chevelle Malibu, Carol Ehm next to her '67 Camaro. Neighbors who are out for an evening walk glance at the photographer in the driveway.
"No, we're not selling them, don't get excited," Carol tells them.
"We'll sell the house first," adds Charlie.
He's only half-kidding.
Charlie and Carol Ehm are part of a small but enthusiastic group that shares this fascination with classic cars. They've competed in Wildwood. They left an event in Wayne with a Sheriff's Choice award.
This Sunday, they will drive their cars to the parking lot adjacent to the Whiskey Caf in Lyndhurst for the Classic Car and Motorcycle Show.
"I know he likes the [mechanics] of it as well as the looks," Carol said. "With me, I just like the looks."
They put this obsession on hold while they raised their kids. Carol jokes that "the '67 Camaro became the '80 Mercury Zephyr [station wagon]." The couple still made it to car shows, dragging their kids along to share in their pastime.
And then in 1998, Charlie got the itch. The kid who grew up driving a hand-me-down '63 Rambler made the decision to purchase a '70 Chevelle Malibu.
"A fellow I worked with had it," Charlie said. "He had twins. He was in the position I was in 30 years ago."
It needed some work. He ripped off the vinyl roof and found nothing but rust. He made a nervous commute from his house to the body shop.
"No bumpers, no headlights, no glass in the front and rear," Charlie said. "I passed three cops on the way to the body shop."
Soon Carol got the itch. In 2006, she would go back to the car that helped win her husband's heart.
"I always loved Camaros," Carol said. "I just kept searching the Internet."
It took her three years to find the '67. She plunked down $32,500 for the car. Six months later, after some body work and a new coat of marina blue paint, Carol had it appraised at $40,000.
The cars are not very practical. Charlie said he's driven his Chevelle fewer than 3,000 miles since he bought it nine years ago. They require premium fuel. Carol's car gets about 15 or 16 miles per gallon on the highway. And if the car breaks down, good luck persuading a tow truck driver to be gentle.
But they wouldn't trade their cars and the enjoyment of taking them to cruise nights in Jersey. Charlie and Carol are already spreading the gospel to the next generation. Austin, the couple's 2-year-old grandson, is a convert. Carol sometimes lets him sit in the driver's seat of her Camaro.
"Let's roll!" he yells.
Pity the girl who wants to win his heart. She might need a flashy car to get his attention.

NSW: Tristar challenges workers to pick up tools
SYDNEY, Feb 1 AAP - Sydney car parts maker Tristar Steering and Suspension has challenged
its thirty-five employees seeking redundancy payouts to start work.
The company, which has slashed its workforce by 90 per cent during restructuring, maintains
its Marrickville factory is operational and therefore its workers are not entitled to
redundancy payouts.
Industrial Relations Minister Joe Hockey, who this week failed to persuade Tristar
to pay out the 35 workers, has said he is sceptical about the company's claims about the
plant.
The workers are reportedly being paid to go into work and listen to the radio and read
the paper until a redundancy agreement promising them four week's pay for each year of
service expires.
Tristar said in a statement today that there was two years of work at the plant reconditioning
existing stock but workers were refusing to do it.
"Tristar will not close down the business when there is work to be done," the statement said.
"The question for the union and the workers is whether they will work.
"Will they comply with legally sanctioned directions from Tristar to commence work
on re-manufacturing?"
The Australian Industrial Relations Commission this month approved the right for Tristar
to have workers conduct re-manufacturing work.
The company said it had been forced to bring in contractors to clean and dismantle
equipment in the re-organisation of the Marrickville plant, expected to be up and running
next week, as workers refused to help.
Separate to these negotiations, the company caved in to pressure from politicians and
the media, agreeing to pay a $50,000 voluntary redundancy to former accounts manager John
Beaven before he died of cancer last week.

Fed: 24 military personnel face action after positive drug tests
A handful of Australian military personnel face punishment after returning positive drugs tests.
The 24 face disciplinary action following random drug tests on more than one thousand
army, navy and air force personnel last year.
The Australian newspaper reports today Defence Minister BRENDAN NELSON confirmed the
results yesterday.
It comes as the federal government considers relaxing rules governing entry to the
defence forces which would allow former cannabis users to join the military.
Dr NELSON says it made little sense to exclude a person from a possible military career
simply because they had once tried drugs .. but a zero tolerance policy would apply once
they had joined the armed forces.

Bluelight alters Internet access fee.
SAN FRANCISCO -- The free ride is about to come to an end for consumers who receive their Internet access through Bluelight.com. Bluelight and Kmart announced that monthly access fee now will be $8.95.
Launched in January 2000, Bluelight offered consumers free, unlimited Internet service and rapidly accumulated 3 million users within its first seven months. By March 2001, the company began charging new users $9.94 for 100 hours of service monthly, and began reducing the number of access hours existing users could take advantage of free of charge.
At the end of August, charter Bluelight subscribers will no longer receive free service. Those who already pay for the service will have their rates reduced to $8.95 per month for unlimited Internet access. Anyone signing up for the service before Sept. 1 will receive the first three months of service for $6.95.
In addition, consumers who buy any non-clearance item from the site will receive one month free service, up to a maximum of six months of free service.

TaoTalk, the European real-time Internet voice chat and voice messaging specialist, has partnered with translation service Communicado to provide an Internet based audio conference facility to businesses worldwide.
The new offering will operate as a 'plug-in' service, allowing companies using TaoTalk's online communication tools to take advantage of a real-time translation service.
Although the service will initially be operating within European working hours, TaoTalk is intending to offer the facility to SMEs around the world.
The 'plug-in' translator will operate on two pay models: pay-asyou-go and subscription based.
TaoTalk has recently appointed Willy-Francois Poulet as CEO. Founder Alex Meisi has become chairman. Poulet moved over to TaoTalk from Braxton Associates, the financial management arm of Deloitte Consulting.

The Brazilian model and American football star are set to wed after Tom got down on one knee and proposed with a diamond solitaire ring in Los Angeles on Friday. A source said: "He asked and she accepted. The couple are discussing a huge fashionista event in the spring or a more intimate and quicker ceremony in Costa Rica, where Gisele has a home."
